I.- PURPOSE AND SCOPE

These provisions are intended to govern the use of the sales services for the various goods and services offered in the online store www.kingregal.com owned by King Regal, S.A., with tax identification number B98626567, hereinafter King Regal.

The clauses set out below constitute the framework agreement that all users who access the website www.kingregal.com are required to know and accept. Solely for the purposes of these general terms and conditions, the term “user” includes any Internet user who accesses the website www.kingregal.com, whether directly or through any other website.

The services offered by King Regal. On this website, transactions shall be governed by the terms contained in this agreement. King Regalreserves the right to modify these general terms and conditions, in whole or in part, with the new terms adopted applying from the time they are published on the website. In any event, such modifications shall not have retroactive effect on goods or services previously contracted by users.

These General Terms and Conditions are binding on both parties and form an integral and inseparable part of the sales contract, which takes effect when the customer submits an order through the contracting mechanisms specified below, all in accordance with Article 1,255 of the Civil Code, which establishes the principle of freedom of contract and agreements between the contracting parties. For all purposes, placing an order shall be understood as the user's acceptance of the terms and rules of use set out herein.

To fully safeguard the rights of King Regal’s consumers and users, these General Terms and Conditions are established in accordance with Spanish law, and in particular Law 26/84 of June 19 on the General Protection of Consumers and Users, Law 7/98 of April 13 on General Contracting Terms, Law 7/96 of January 15 on the Regulation of Retail Trade, the Civil Code, Directive 2000/31/EC of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 on information society services and electronic commerce, Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods, and all other applicable laws and implementing regulations.

II. IDENTIFICATION AND CORPORATE NAME OF THE OFFERING COMPANY
King Regal S.A. provides online confectionery sales services through its website, www.kingregal.com.

Its contact address is the email address hola@kingregal.com.  The address for filing complaints shall be the company’s registered office: C. Nicolás Copérnico, 10, P.I. El Brosquil – 46780 Oliva (Valencia, Spain).

III. PURPOSE
These General Terms and Conditions govern the contracting of products and services offered by King Regal S.A. and the advertising directed at its customers/users, all through its website, as well as the rights and obligations of the parties arising from the purchase and sale transactions entered into between them.

IV. LEGAL TERMS AND CONDITIONS GOVERNING THE PROVISION OF THE SERVICE, LIABILITY, CLARITY, AND TRANSPARENCY OF INFORMATION

In compliance with Article 10 of Law 34/2002 of July 11, King Regal enables permanent, easy, direct, and free electronic access, through its website and these General Terms and Conditions, to information including its corporate name (tax and registry details, registered office, and communications address), as well as customer data held by the company that is accessible exclusively to the customer.

V. USER/CUSTOMER ACCESS TERMS AND CONDITIONS

Users of the King Regal websiteshall have the right to free access to the public information available on the website, although King Regal reserves the right to restrict access to information, promotions, and special offers to registered customers.

Any user over 18 years of age who accesses the King Regal websitehave the right to register as customers and may therefore take advantage of the special offers intended for registered customers, provided they meet the specific conditions of the offer applicable to each product.

The public information contained on the King Regal website, relating both to the company King Regal, including the trademarks, products, logos, and other materials of the wholesale companies and manufacturers of the products and services offered, are protected by the legal provisions on intellectual and industrial property. Accordingly, copying, transmitting, assigning, transferring, or using them by the customer for purposes other than the advertising purpose of their online publication is not permitted without the express consent of King Regal, from the product manufacturer or the owner of trademarks and logos, under the terms set out in Section XI on Industrial and Intellectual Property Rights.

USER REGISTRATION

Before formalizing the purchase of any of the products offered by King Regal must register the personal details and other information necessary to formalize the sales contract (full name or company name, national identity number/tax identification number/company tax number, address, email address, telephone/fax number).

To place orders on the website, each customer must provide King Regal, voluntarily and under their own responsibility, their personal data.

All personal data provided by customers fraudulently or falsely may be considered an offense of falsifying commercial documents.

King Regal may offer the customer a personal registration system using a personalized access code (login) and password to facilitate future purchases. In such cases, the customer may choose the desired login and password at their discretion, provided that they are available and have not been assigned to other customers.

The customer undertakes to ensure the confidentiality of their own access code and password. King Regal shall be exempt from any liability arising from the customer's improper use of or negligence in fulfilling their obligation to keep their access credentials confidential.

VI.- OFFER AND ACCEPTANCE PROCESS.

TERMS AND CONDITIONS OF SALE AND PRODUCT DELIVERY

Pricing policy: King Regal, reserves the right at all times and unilaterally to modify the prices of the products and services offered through its website. To guarantee customers certainty and security regarding the price of its products, the applicable price will be the one shown in the advertising current at the time the order is placed.

The following steps will be followed in the electronic purchasing process, in accordance with the options menu provided on the King Regal website.

Information about the product offered to the customer: description, manufacturer's brand, illustrative photograph, price including taxes.

Due to manufacturer availability, the purchased product may undergo non-substantial changes to the components, characteristics, or features of the lot comprising it, provided that such changes do not diminish the advertised quality or performance.

Information about the product price: information on the final price or retail price of the product to be purchased, including the customer's total final cost, VAT, shipping costs, and insurance and handling charges arising from transport. The final cost will therefore be communicated to the customer during the electronic purchasing process before the customer confirms acceptance by selecting the “Place order” option. Any applicable discounts or promotional gifts will be determined at King Regal’s discretion to the groups designated by King Regal from time to time, or depending on the product offered, in accordance with the advertising displayed on its website at any given time.

Order acceptance: when the order is placed, once the order acceptance option in the menu has been used, the customer's consent is deemed to have been given for the validity and effectiveness of the sale and purchase contract, which binds both parties. The customer acknowledges being over 18 years of age for the purchase of alcoholic beverages. King Regal will store the order electronically.

The commitment undertaken by King Regal, for the sale and delivery of the goods offered is subject to the stock of the advertised product and its availability while supplies last, therefore King Regal, in its commitment to quality and customer service, makes every effort to ensure that the advertised products are available at all times. However, should exceptional circumstances arise involving interactive multiple orders or any other circumstances that result in the product becoming out of stock, the order and the contract entered into between the parties shall be rendered null and void pursuant to this termination clause. In the event of prepayment, the customer shall be fully refunded the amounts paid, with neither party being entitled to any compensation for breach of contract, actual loss, or loss of profits.

Payment methods available to the customer: the following payment methods are available.

Payment by card through the secure PayPal platform:

The Customer agrees to pay at the time the order is placed. They will receive an order confirmation by email immediately after completing the purchase.

a fully secure redirection to PayPal's payment gateway, where they can make the payment using their usual credit card. Banking details are always transferred directly to PayPal through secure gateways and servers (our company is not involved in this process and therefore does not store any data). Please contact your bank to activate this secure payment service.

Once the purchase has been completed, you will be redirected back to the website.

Bank transfers:

With this payment method, you can pay for your order by bank transfer, paying the full order amount into the account number provided at the end of the purchase. You will receive an email containing the details required to make the deposit.

It is very important that, in the payment reference field, you indicate the order number that we will provide at the end of your purchase.

You have a period of 2 calendar days after placing your order to arrange the bank transfer. Once we receive confirmation of the payment from our bank, we will activate your order. From the time the transfer is arranged until we receive the notification, it is normal for 24 to 48 hours to pass, depending on how long the customer takes to make the transfer. You should therefore take this into account when calculating when you will receive your package.

The order will be canceled once 3 business days have elapsed from the date the order was placed without the relevant transfer having been received.

Invoice: King Regal will issue an electronic invoice (PDF) and send it to you by email once the sale has been completed. King Regal, advises that sales invoices cannot subsequently be modified in compliance with current regulations (Royal Decree 1496/2003 on invoicing rules, amended by Royal Decree 87/2005). The invoice will be issued in the name of the individual or company placing the order, so the customer must ensure that the order is placed under the correct name. Subsequent changes will not be possible.

Delivery period for the purchased product: a period of 2 to 5 days is established for effective delivery of the product, counting from the date on which its delivery was scheduled when the order was placed, for mainland Spain, the Balearic Islands, and Portugal, and once payment for the order has been transferred and proof of payment received.

Place and method of delivery: The order will be delivered to the address designated by the customer at the time of purchase. Any subsequent change to the delivery address requested by the customer may incur additional costs on top of the sale price, which will be borne by the buyer. The goods will be delivered to the customer by a transport company, together with a delivery note containing the information needed to identify the customer and the order, as well as the number of packages making up the shipment. The goods are covered at all times against the risks of transport, loss, and handling.

If, at the time of delivery, the customer identifies errors in the goods received or finds that they are visibly damaged, these circumstances must be noted on the carrier’s delivery note and reported to King Regal in writing within 24 hours (by email to hola@kingregal.com), via the customer service provided on its website or at the company’s registered office. In all cases, the customer must verify that the goods have been delivered in perfect condition. Claims made more than 24 hours after delivery cannot be accepted.

Goods that could not be delivered within 24 business hours of leaving King Regal’s facilities for reasons not attributable to the seller will be returned to the seller, and any amounts paid will be refunded in the case of prepaid orders.

VII.- PRODUCT WARRANTIES

The warranty for products sold by King Regal is provided and established pursuant to the existing regulations on warranties for the Sale of Consumer Goods. This legal framework is intended to provide consumers with various options for requesting remedies when the purchased goods do not conform to the contract, allowing them to request the repair or replacement of the goods, unless this is impossible or disproportionate. When repair or replacement is impossible or disproportionate, the consumer may request a price reduction or termination of the contract.

Commercial Warranty: Manufacturers may offer additional warranties, the scope and duration of which vary depending on the products and brands. Such warranties will be the sole responsibility of the manufacturer providing them. Under this law, the seller is obliged to deliver goods to the consumer that conform to the sales contract under the terms established by the law itself. Therefore, as established in Article 4 of the aforementioned law concerning the seller’s liability and the buyer’s rights: “The seller shall be liable to the consumer for any lack of conformity existing at the time the goods are delivered. Under the terms of this law, consumers are recognized as having the right to repair of the goods, replacement, a price reduction, and termination of the contract.” In all cases, the product batch number of the item to be repaired must correspond to the records held by King Regal.

King Regal shall not be liable for any damage resulting from misuse or improper handling of the product. The warranty shall not be valid in the event of factors unrelated to normal use of the product by the customer or by third parties not authorized by the manufacturers. The warranty period shall begin on the date of delivery.

To regulate aspects of the commercial warranty not covered by Law 23/2003, the provisions set out in Law 7/1996 of January 15 on the Regulation of Retail Trade shall apply.

VIII.- CUSTOMER RIGHTS

Confidentiality and security of the customer's personal data in accordance with the applicable Spanish data protection legislation. The customer's data will not be disclosed, transferred, or published without their express consent. Promotional or advertising emails will not be sent if the customer has opted out of receiving them. The customer may view, modify, and delete their personal data held in the King Regal database at the customer's request, all in accordance with the provisions set out in the section on Personal Data Protection.

Free access to the open sections of the King Regal website. Know the processing status of the order placed at any time.

Unilateral cancellation/revocation of the requested order: 

Under the applicable legislation (Sole Article amending the consolidated text of the General Law for the Protection of Consumers and Users and other supplementary laws, approved by Royal Legislative Decree 1/2007 of November 16), you have 14 calendar days from the delivery date to return a product if you are not satisfied with it. Return shipping costs to our facilities shall be borne by the customer.

The packaging and shipping service used must ensure that the shipment arrives in perfect condition. It must be sent through a specialized courier company.

Once we receive the product and verify that it is in perfect condition, we will refund the product amount to your account. The shipping costs paid for dispatching the product cannot be refunded.

Returns sent postage due will not be accepted, and no merchandise will be accepted without prior notification. To arrange an exchange or return, please contact our Customer Service Department by email at hola@kingregal.com and wait for return confirmation.

Packages leaving our facilities are perfectly packed. If you receive a package that is visibly damaged or tampered with, indicate this on the carrier’s delivery note and inform us within a maximum of 24 hours. After this time, we will be unable to file a claim with the carrier, and the package will therefore be deemed accepted by the customer.

If you exercise this right of withdrawal, the customer shall be responsible for the return shipping costs and any damage suffered by the product or goods. Returns will not be accepted in cases where the product has been used, the seal has been broken, or the container has been opened. Return shipping costs will be deducted from the product price when the refund is issued. Under no circumstances can return or exchange procedures be handled at our registered office.

King Regal will not accept returns of products handled by the customer or goods returned incomplete, either in their main components or accessories. The right of withdrawal shall not apply after the indicated deadline or to products that, by their nature, cannot be returned. Nor shall the right of withdrawal apply to goods or orders that, due to their special characteristics, can be considered custom-made according to the customer’s specifications.

IX.- USER/CUSTOMER OBLIGATIONS

• Keep their personal login credentials secure and exercise due care.
• Be over 18 years of age.
• Use the information published by King Regal  exclusively by the customer and strictly within the intended personal commercial relationship.
• Reproduce, transfer, or otherwise dispose of the information published by King Regal, in all its content, without the company’s express permission.
• Use the purchasing service provided by King Regal on its website properly, refraining from tampering with the content of its website or interfering with its computer systems through viruses or other conduct prohibited by law.
• Honor the purchase agreement once the order has been accepted, with prompt payment of the agreed price.

X.- KING REGAL’S RIGHTS

• Maintain, modify, or suspend its website without prior notice.
• Change the prices of the offers.
• Reject orders due to lack of stock, errors, typographical mistakes, or customer nonpayment.
• Deny customers access to the IT tools in the event of noncompliance with these terms.
• Collect payment for the customer's purchases once the transaction has been accepted.
• Reserve ownership of the domain and retain full ownership of the item until the customer has paid in full.
• Reserve the right to hold drawings for goods or services on its website.
